Some of our members were busy this week. Lesley made a trip to Austin, Texas and Bradley drove to Wichita, Kansas. Great job, both of you!

    I would be happy if Texas were to sink Obama.

    I wonder if Justice Scalia can guide us to any honest judges there in Texas, judges who know that grand juries are not textually assigned to the Executive, Legislative, or Judicial branches.

    Any District Court in Texas would likely take their Circuit Justices opinion to heart. The rulings that Scalia supported with regard to Presentments should be included with any case undertaken there.That will help to give guidance to the district court judges in Texas.
    If a case moves forward in ONE Circuit which supports presentments,even if the other 12 Circuits refuse to recognize them,that would create a federal question that the SCOTUS would HAVE to resolve as a constitutional issue. It would be a conflict between one or more circuit courts and would have to be resolved.

    I wish Kansas was under Justice Scalia’s circuit jurisdiction.

    Kansas is in the Tenth Circuit. Texas,Louisianna and Mississippi are in Scalia’s Circuit,the Fifth Circuit.
